The CDC has extended the federal eviction moratorium once again to July 31, 2021.
In unwelcome news to landlords, The Centers for Disease Control (CDC) has once again extended the federal eviction moratorium by one month to July 31. At the same time, the Federal Housing Finance Agency (FHFA) announced that Fannie Mae and Freddie Mac are extending the moratoriums on single-family foreclosures and REO evictions until July 31, as well. extended the ban they made clear that this would be the last extension.
Realtor Associations are fighting back. Both the Georgia and Alabama Associations of Realtors filed in U.S. Courts. The courts favored challenges by the Associations, stopping short of ending the eviction moratorium pending an appeal by the Department of Justice.
On June 2, the U.S. Court of Appeals for the D.C. Circuit ruled against a motion filed by the plaintiffs seeking to vacate the emergency eviction moratorium issued by the U.S. District Court for the District of Columbia.
In early May, according to NAR, the D.C. District Court vacated the CDC moratorium based on statutory overreach, which the Department of Justice appealed. However, the district court issued an emergency stay pending that appeal and the D.C. Circuit Court’s recent action upheld that stay. In response, the plaintiffs have petitioned the Supreme Court to vacate the stay before the CDC order expires at the end of June. Housing providers should continue to the monitor the case, as the CDC’s eviction moratorium remains in effect nationwide through its expiration on June 30th, or any further extensions, pending consideration by the Supreme Court.
