Right to list agreement firm<\/a> MV Realty<\/strong> is under fire again, this time from the Ohio Attorney General. In a lawsuit<\/a> filed last Monday in the Franklin County Common Pleas Court, Ohio Attorney General Dave Yost claims that MV Realty\u2019s contracts violate Ohio state law and that the firm does not have proper real estate licensing.<\/p>\n\n\n\n

As a result, Yost is seeking a preliminary injunction against MV Realty of Ohio, as well as the company\u2019s founder, Amanda Zachman<\/a>, and the firm\u2019s principal broker, Diana Remar, to stop them from negotiating real estate contracts.<\/p>\n\n\n\n

This is the fourth state attorneys general lawsuit that MV Realty is currently facing. At the end of 2022, attorneys general in Massachusetts<\/a>, Florida<\/a> and Pennsylvania all filed suits against the firm.<\/p>\n\n\n\n

The Ohio lawsuit alleges that MV Realty founder Amanda Zachman and broker Diana Remar confuse and mislead homeowners with the company\u2019s contracts, which omit crucial information and language required by state law.<\/p>\n\n\n\n

\u201cThe Homeowner Benefit Program<\/strong> and Homeowner Benefit Agreement<\/strong> are misleading and confuse homeowners. This HBA agreement<\/a> mirrors an exclusive right to list agreement and an agency agreement,\u201d Yost wrote in the suit.<\/p>\n\n\n\n

According the suit, the HBP contracts omit information and language mandated by Ohio state law, including the name of the agent to be used, the required fair housing language, the required anti-blockbusting language, a clear statement for the expiration of the agreement, and a clear statement of representation.<\/p>\n\n\n\n

In addition, the lawsuit maintains that Zachman, who lives in Delray Beach, Fla., is not licensed in Ohio as a real estate salesperson, but is illegally acting as one through MV Realty and Remar, who is a licensed Ohio broker.
