In a virtual hearing held on Tuesday, Judge Thomas Zilly, a judge for the U.S. District Court in Seattle, set a jury trial date of September 18, 2023.<\/p>\n\n\n\n<p>In addition to setting the trial date, Zilly also granted REX\u2019s motion to compel NAR to run certain electronic searches in response to REX\u2019s request for document production, denied Zillow\u2019s motion to compel additional federal rules of civil procedure testimony, and granted in part and denied in part NAR\u2019s motion to compel REX to produce \u201cimproperly withheld documents and information.\u201d<\/p>\n\n\n\n<p>REX filed the <a href=\"https:\/\/www.realtrends.com\/blog\/articles\/rex-real-estate-files-lawsuit-against-zillow-nar\/\" target=\"_blank\" rel=\"noreferrer noopener\">antitrust lawsuit<\/a> in March 2021 against Zillow, <strong>Trulia<\/strong> and NAR, alleging that changes made to Zillow\u2019s website \u201cunfairly hides certain listings, shrinking their exposure and diminishing competition among real estate brokers.\u201d<\/p>\n\n\n\n<p>In <a href=\"https:\/\/www.realtrends.com\/blog\/articles\/rex-real-estate-files-lawsuit-against-zillow-nar\/\" target=\"_blank\" rel=\"noreferrer noopener\">January 2021<\/a>, Zillow began moving homes out of its initial search results for sellers who chose not to use agents adhering to the NAR and local multiple listing service (MLS) practices.<\/p>\n\n\n\n<p>In a press release at the time, REX said it was looking to break \u201cthe stranglehold that REX believes the NAR and its members have held over consumers for generations, resulting in fees that are two to three times higher than in most developed countries. REX filed the lawsuit after the company\u2019s clients complained about the second-class treatment that non-cartel homes were receiving.\u201d<\/p>\n\n\n\n<p>In January 2022, NAR filed a <a href=\"https:\/\/www.realtrends.com\/blog\/articles\/the-legal-battle-between-rex-homes-and-nar-heats-up%ef%bf%bc\/\" target=\"_blank\" rel=\"noreferrer noopener\">countersuit<\/a> claiming that REX uses false advertising and misleading claims to deceive consumers in violation of the Lanham Act, but the <a href=\"https:\/\/www.realtrends.com\/blog\/articles\/court-dismisses-nars-countersuit-against-rex\/\" target=\"_blank\" rel=\"noreferrer noopener\">countersuit was dismissed<\/a> in late April 2022.<\/p>\n\n\n\n<p>Since then, REX, Zillow and NAR have gone back and forth with filing various <a href=\"https:\/\/www.realtrends.com\/blog\/articles\/judge-orders-nar-execs-to-turn-over-documents-in-rex-case\/\" target=\"_blank\" rel=\"noreferrer noopener\">motions to compel<\/a> during the discovery phase of the trial, but it appears that will all come to a head this fall.<\/p>\n\n\n\n<p>\u201cWe continue to maintain that the claims made in REX\u2019s lawsuit are without merit,\u201d a spokesperson for Zillow wrote in an email. \u201cREX chose to use Zillow\u2019s services to advertise their for-sale properties on Zillow \u2013 for free. Zillow has consistently advocated for outdated rules to be changed to allow the broader display of all listings on all platforms, including For Sale By Owner and listings from companies like REX \u2013 we look forward to discussing these facts before the court.\u201d<\/p>\n\n\n\n<p>Mantill Williams, NAR&#8217;s VP of communications, shared a similar sentiment in his emailed statement: &#8220;NAR continues to believe this lawsuit is without merit and remains confident we will ultimately prevail. NAR guidelines and local broker marketplaces create highly competitive markets, empower small businesses and ensure equitable home ownership opportunities, superior customer service and greater cost options for all buyers and sellers.&#8221;<\/p>\n\n\n\n<p>While NAR still faces other antitrust lawsuits, a U.S. District Court judge in the District of Columbia recently <a href=\"https:\/\/www.realtrends.com\/blog\/articles\/nar-victorious-in-renewed-doj-antitrust-probe\/\" target=\"_blank\" rel=\"noreferrer noopener\">ruled in the trade group\u2019s favor<\/a>, ending the Department of Justice\u2019s probe into its \u201cparticipation rule\u201d and \u201cclear cooperation policy.\u201d<\/p>\n\n\n\n<p>A request for comment sent to REX had not been returned at the time of publication.<\/p>\n\n\n\n<p><em>This story was updated to include commentary from NAR.<\/em><\/p>\n","protected":false},"excerpt":{"rendered":"<p>A U.S. District Court judge in Seattle set a September trial date in the REX Homes, Zillow Group, and NAR antitrust lawsuit.<\/p>\n","protected":false},"author":34740,"featured_media":4822,"comment_status":"open","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"_acf_changed":false,"_jetpack_memberships_contains_paid_content":false,"footnotes":""},"categories":[3255],"tags":[],"coauthors":[1760],"class_list":["post-3939","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-archive"],"acf":[],"yoast_head":"<!-- This site is optimized with the Yoast SEO Premium plugin v25.4 (Yoast SEO v26.8) -
