{"id":3741,"date":"2022-12-01T23:12:58","date_gmt":"2022-12-01T23:12:58","guid":{"rendered":"https:\/\/www.realtrends.com\/blog\/2022\/12\/01\/nc-petition-calls-for-stronger-flood-disclosures\/"},"modified":"2025-03-13T02:48:11","modified_gmt":"2025-03-13T02:48:11","slug":"nc-petition-calls-for-stronger-flood-disclosures","status":"publish","type":"post","link":"https:\/\/www.realtrends.com\/blog\/2022\/12\/01\/nc-petition-calls-for-stronger-flood-disclosures\/","title":{"rendered":"NC petition calls for stronger flood disclosures"},"content":{"rendered":"\n<p><strong>The Southern Environmental Law Center<\/strong> petitioned the <strong>North Carolina Real Estate Commission<\/strong> to require sellers to disclose information about past flood damages to potential homebuyers.<\/p>\n\n\n\n<p>The petition was filed on behalf of <strong>Natural Resources Defense Council<\/strong> (NRDC), <strong>North Carolina Justice Center<\/strong>, MDC, North Carolina Disaster Recovery and Resiliency School, Robeson County Church and Community Center, and NC Field.<\/p>\n\n\n\n<p>The aim of the petition is to help buyers make informed decisions about their home or investment purchases considering the risk of flooding at a property. It also requests an amendment to North Carolina Real Estate Commission\u2019s mandatory disclosure form, a requirement of The Residential Property Disclosure Act, to ask for more information about flood history and risk.<\/p>\n\n\n\n<p>\u201cIt\u2019s common sense to give North Carolinians the necessary information to know if they will need flood insurance before buying a property,\u201d said Brooks Rainey-Pearson, senior attorney at Southern Environmental Law Center, in a statement. \u201cThe Real Estate Commission can help level the playing field for homebuyers in North Carolina and make sure that they know about the flood risks that come with a house.\u201d<\/p>\n\n\n\n<p>The Real Estate Commission currently requires property sellers to disclose if a property is located in a floodplain or is subject to a flood hazard.&nbsp;<\/p>\n\n\n\n<p>The language used in the North Carolina disclosure does not, however, share a property\u2019s flood history, which includes actual damages, costs of flood insurance and whether previous owners received federal disaster assistance, according to the release.<\/p>\n\n\n\n<p>On the other hand, states that are prone to floods and hurricanes like <a href=\"https:\/\/help.riskfactor.com\/hc\/en-us\/articles\/360049236793-Learn-about-flood-risk-disclosures-and-which-states-have-them-#:~:text=For%20example%2C%20Louisiana%20requires%20sellers,and%20maintain%20flood%20insurance%20for\">Louisiana<\/a> and <a href=\"http:\/\/trec.texas.gov\/article\/trec%E2%80%99s-latest-meeting-results-new-flood-disclosure-form-leases-updated-broker-responsibility#:~:text=A%20bill%20passed%20during%20the,within%20the%20last%20five%20years.\">Texas<\/a> require sellers to provide homebuyers a home\u2019s flood history before purchase.<\/p>\n\n\n\n<p>Joel Scata, senior attorney at NRDC, says it is unfair to buyers if they are not aware of all relevant information before they choose a property.<\/p>\n\n\n\n<p>\u201cA home that is flooded once is likely to get hit again, and buyers should have the right to know that information given how costly flooding can be for a homeowner,\u201d Scata added.<\/p>\n\n\n\n<p>A <a href=\"https:\/\/www.milliman.com\/-\/media\/milliman\/pdfs\/2022-articles\/7-29-22_nrdc-estimating-undisclosed-flood-risk.ashx\">study <\/a>by independent actuarial consulting firm <strong>Milliman<\/strong>, appointed by NRDC, found North Carolina homebuyers incur losses for damages owing to the state\u2019s disclosure requirements. The report states that North Carolina, New Jersey and New York have inadequate disclosure requirements.<\/p>\n\n\n\n<p>According to <a href=\"https:\/\/drive.google.com\/file\/d\/1-UBZwKZdVNePhm0lJwgq5a6gS_Nz9y-F\/view\">NRDC research<\/a>, more than eight in 10 voters in North Carolina favor a strong flood disclosure, with bipartisan support for making homebuyers aware of flood risks to their preferred properties.<\/p>\n\n\n\n<p>\u201cFlood disclosures are vital in inland communities where potential buyers may not even think to ask about the real and significant risk of flooding that comes from rain generated by a hurricane,\u201d said Brittany Love, director of systemic programming at the Robeson County Church and Community Center in Lumberton, in the release.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The Southern Environmental Law Center petitioned the North Carolina Real Estate Commission to strengthen flood disclosures for homebuyers.<\/p>\n","protected":false},"author":39545,"featured_media":4822,"comment_status":"open","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"_acf_changed":false,"_jetpack_memberships_contains_paid_content":false,"footnotes":""},"categories":[3255],"tags":[],"coauthors":[2886],"class_list":["post-3741","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-archive"],"acf":[],"yoast_head":"<!-- This site is optimized with the Yoast SEO Premium plugin v25.4 (Yoast SEO v26.8) -
