{"id":3131,"date":"2022-05-19T20:08:41","date_gmt":"2022-05-19T20:08:41","guid":{"rendered":"https:\/\/www.realtrends.com\/blog\/2022\/05\/19\/realogy-tcpa-class-action-suit-headed-to-trial\/"},"modified":"2025-03-13T02:43:06","modified_gmt":"2025-03-13T02:43:06","slug":"realogy-tcpa-class-action-suit-headed-to-trial","status":"publish","type":"post","link":"https:\/\/www.realtrends.com\/blog\/2022\/05\/19\/realogy-tcpa-class-action-suit-headed-to-trial\/","title":{"rendered":"Realogy TCPA class action suit headed to trial"},"content":{"rendered":"\n<p><strong><a href=\"https:\/\/www.realtrends.com\/blog\/articles\/jury-rules-in-favor-of-redfin-in-patent-infringement-suit\/\" target=\"_blank\" rel=\"noreferrer noopener\">Redfin<\/a><\/strong>, <strong><a href=\"https:\/\/www.realtrends.com\/blog\/articles\/rex-closes-brokerage-hires-david-boies-in-zillow-lawsuit\/\" target=\"_blank\" rel=\"noreferrer noopener\">REX<\/a><\/strong> and the <strong><a href=\"https:\/\/www.realtrends.com\/blog\/articles\/court-dismisses-nars-countersuit-against-rex\/\" target=\"_blank\" rel=\"noreferrer noopener\">National Association of Realtors<\/a><\/strong> are not the only real estate industry entities embroiled in litigation. <strong>Realogy<\/strong>, which recently <a href=\"https:\/\/www.realtrends.com\/blog\/articles\/realogy-rebrand-buy-or-sell-your-home-anywhere\/\" target=\"_blank\" rel=\"noreferrer noopener\">rebranded<\/a> as <strong>Anywhere<\/strong>, faces its own legal woes.<\/p>\n\n\n\n<p>The real estate conglomerate lost its bid for a summary judgement in a <strong>Telephone Consumer Protection Act<\/strong> class action lawsuit, according to an order filed last Wednesday and first <a href=\"https:\/\/www.natlawreview.com\/article\/more-bad-tcpa-news-major-brokerage-loses-summary-judgment-certified-tcpa-suit-must\" target=\"_blank\" rel=\"noreferrer noopener\">reported<\/a> by the <strong>National Law Review<\/strong>. The lawsuit is now headed to trial.<\/p>\n\n\n\n<p>The <a href=\"https:\/\/www.texasrealestate.com\/members\/communications\/texas-realtor-magazine\/issues\/june-2019\/recent-lawsuit-targets-cold-calling-by-real-estate-companies\/\" target=\"_blank\" rel=\"noreferrer noopener\">class action suit<\/a> was filed in 2019 in a U.S. District Court in Northern California and centers on an alleged TCPA violation. In the suit, plaintiffs contend they received unwanted, autodialed calls from <strong>Coldwell Banker<\/strong> and <strong>NRT<\/strong> agents, despite being on the <strong>National Do Not Call Registry<\/strong>.<\/p>\n\n\n\n<p>\u201cCompanies like Defendant flagrantly ignores the Registry and invade the privacy of consumers with unwanted calls,\u201d the suit states.<\/p>\n\n\n\n<p>Both the plaintiffs and the defendants filed for a summary judgement in their favor in late February 2022.<\/p>\n\n\n\n<p>In issuing his denial, U.S. District Judge James Donato wrote: \u201cAs the parties\u2019 own motion papers amply demonstrate, this case is replete with disputes of material fact that a jury will be required to resolve. Each party filed hundreds of pages in briefing, declarations and exhibits with their motions. While volume alone is not necessarily fatal to a summary judgment motion, these filings reflect an almost total disagreement between the parties about the facts of the case.\u201d<\/p>\n\n\n\n<p>Donato also maintains the evidence presented by the parties offers conflicting views on Realogy\u2019s \u201cvicarious liability for Coldwell Banker agents\u2019 calls by apparent agency or ratification, and Realogy\u2019s consent and safe harbor defenses under the TCPA.\u201d<\/p>\n\n\n\n<p>Three separate classes have been certified in the suit. The first class, deemed the \u201cNational Do Not Call Registry Nationwide\u201d class, consists of all persons in the U.S. \u201cwho received two or more calls made by a [Defendant]-affiliated agent using a <strong>Mojo<\/strong>, <strong>PhoneBurner<\/strong>, and\/or <strong>Storm dialer<\/strong> in any 12-month period on a residential landline or cell phone number that appeared on the National Do Not Call Registry for at least 31 days for the time period beginning June 11, 2015, to present.\u201d<\/p>\n\n\n\n<p>The second class, known as the \u201cNational Internal Do Not Call\u201d class, is made up of anyone in the U.S. \u201cwho received, in any 12-month period, two or more calls promoting [Defendant\u2019s] services and made by a [Defendant]-affiliated agent to their residential landline or cell phone number, for the time period beginning June 11, 2015, to present.\u201d<\/p>\n\n\n\n<p>The final class, termed the \u201cNational Artificial or Prerecorded Message\u201d class, includes anyone in the U.S. who received a call on their residential telephone line or cell phone number with an artificial or prerecorded message, as indicated by the following call disposition codes: (1) \u2018Drop Message\u2019 (if using the Mojo dialer); (2) \u2018ATTENDED_TRANSFER\u2019 (if using the Storm dialer; and (3) \u2018VOICEMAIL\u2019 (if using a PhoneBurner dialer) in the call records listed in Appendix A and made by a [Defendant]-affiliated Agent for the time period beginning June 11, 2015, to present.\u201d<\/p>\n\n\n\n<p>In total, the classes include more than 445,000 unique cellphone numbers.
