{"id":2882,"date":"2022-02-23T19:14:13","date_gmt":"2022-02-23T19:14:13","guid":{"rendered":"https:\/\/www.realtrends.com\/blog\/2022\/02\/23\/the-legal-battle-between-rex-homes-and-nar-heats-up\/"},"modified":"2025-03-13T02:40:27","modified_gmt":"2025-03-13T02:40:27","slug":"the-legal-battle-between-rex-homes-and-nar-heats-up","status":"publish","type":"post","link":"https:\/\/www.realtrends.com\/blog\/2022\/02\/23\/the-legal-battle-between-rex-homes-and-nar-heats-up\/","title":{"rendered":"The legal battle between REX Homes and NAR heats up\ufffc"},"content":{"rendered":"\n<p>Discount brokerage <strong>REX Homes<\/strong> (Real Estate Exchange, Inc.) <a href=\"https:\/\/www.docketalarm.com\/cases\/Washington_Western_District_Court\/2--21-cv-00312\/REX_-_Real_Estate_Exchange_Inc_v._Zillow_Inc_et_al\/115\/\" target=\"_blank\" rel=\"noreferrer noopener\">filed<\/a> a motion on Thursday in federal district court in Seattle challenging the legality of the <strong>National Association of Realtors\u2019<\/strong> claims that REX pushes false advertising, which the trade group alleged in a <a href=\"https:\/\/www.realtrends.com\/blog\/nar-fires-back-in-countersuit-against-discount-brokerage\/\" target=\"_blank\" rel=\"noreferrer noopener\">countersuit<\/a> filed late last month.<\/p>\n\n\n\n<p>In the NAR\u2019s filing, the organization alleged that REX makes false and misleading claims to deceive consumers, a violation of the Lanham Act. It said such actions discourage consumers &#8220;from obtaining the pro-consumer, pro-competitive benefits provided by NAR members and independent, local multiple listing services marketplaces.\u201d<\/p>\n\n\n\n<p>These filings are part of ongoing litigation between NAR and REX in the U.S. District Court for the Western District of Washington in Seattle.<\/p>\n\n\n\n<p>REX filed an <a href=\"https:\/\/theamericangenius.com\/housing\/wp-content\/uploads\/sites\/2\/2021\/03\/1.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">anti-trust lawsuit<\/a> against NAR and Zillow last March, but this countersuit filing comes solely from NAR. NAR is seeking an injunction preventing REX from continuing its false and misleading practices, the monetary damages determined at the trial and the reimbursement of costs and attorneys\u2019 fees, but REX sees things differently.<\/p>\n\n\n\n<p>In this latest filing, REX alleges that its public positions are protected speech.<\/p>\n\n\n\n<p>\u201cWhile NAR has and continues to robustly argue its own case in this lawsuit and in many other public forums, NAR now seeks to enjoin REX from itself speaking out against and challenging practices that it believes violate antitrust laws and harm competition,\u201d the motion stated.<\/p>\n\n\n\n<p>In the motion, REX claims that the NAR lacks statutory standing to bring its Lanham Act claim because it did not bring the claim on behalf of its member and has admitted that it does not directly compete with REX. Additionally, REX said that the NAR does not adequately plead proximate causation and that the trade group did not allege any facts showing that REX has frustrated its organization mission.<\/p>\n\n\n\n<p>\u201cNAR\u2019s Lanham Act claim should be dismissed because it infringes on REX\u2019s First Amendment right to express opinions on legal and policy matters,\u201d the motion said.<\/p>\n\n\n\n<p>Later in the motion it states that the NAR \u201cshould not be allowed to use the Lanham Act to suppress REX\u2019s protected speech just because NAR disagrees with the message.\u201d<\/p>\n\n\n\n<p>To be considered \u201ccommercial advertising or promotion\u201d the statements in question made by REX must be commercial speech disseminated to \u201cthe relevant purchasing public to constitute \u201cadvertising\u201d or \u201cpromotion\u201d within that industry\u201d \u201cfor the purpose of influencing consumers to buy goods or services.\u201d<\/p>\n\n\n\n<p>In addition, REX claims that the NAR did not explain exactly how REX\u2019s alleged false advertisting harmed the trade organization.<\/p>\n\n\n\n<p>\u201cNAR does not allege that consumers, brokers, or anyone else have withheld trade from NAR itself,\u201d it stated in the motion. \u201cAt best, the counterclaim can be read to allege injury to NAR\u2019s members and\/or [multiple listing services] that in turn may affect NAR. Absent a showing of \u2018direct conflict\u2019 between a defendant\u2019s conduct and an organization\u2019s expressly stated goals, \u2018it is entirely speculative whether the defendant\u2019s conduct in impeding the organization\u2019s activities.\u201d<\/p>\n\n\n\n<p>In July, the\u00a0<strong>U.S. Department of Justice<\/strong>\u00a0(DOJ)<strong>\u00a0<\/strong>fully walked back a\u00a0<a href=\"https:\/\/www.housingwire.com\/articles\/doj-sues-national-association-of-realtors-for-alleged-antitrust-violations\/\">settlement agreement it reached<\/a>\u00a0with the NAR in the waning months of the Trump administration regarding anti-trust claims. In a statement, the DOJ said it was withdrawing from the settlement so it could undertake a broader investigation into the\u00a0<a href=\"https:\/\/www.housingwire.com\/articles\/are-u-s-real-estate-commissions-illegal\/\" target=\"_blank\" rel=\"noreferrer noopener\">NAR\u2019s rules<\/a>.<\/p>\n\n\n\n<p>A few months later, former NAR president Charlie Oppler wrote an op-ed calling for the DOJ to honor the terms of the deal. <\/p>\n\n\n\n<p>The NAR is currently embroiled in several anti-trust lawsuits, including dozens of <a href=\"http:\/\/housingwire.com\/articles\/49367-anti-trust-lawsuits-contesting-buyer-broker-compensation-rules-heat-up\/?__hstc=43385018.c1200c13b5ffe2d787c2a413a4fe14b9.1635527061029.1645630587202.1645640778170.144&amp;__hssc=43385018.1.1645640778170&amp;__hsfp=3646573209\" target=\"_blank\" rel=\"noreferrer noopener\">lawsuits<\/a>, where the trade organization is the defendant along with <strong>Realogy<\/strong>, <strong>RE\/MAX<\/strong>, <strong>Keller Williams<\/strong> and <strong>HomeServices of America<\/strong>, from homebuyers and sellers that aim to have homebuyers pay their broker directly instead of the listing broker pay the buyer&#8217;s broker from the listing broker\u2019s commission.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Discount brokerage REX filed a motion in federal district court last week challenging the legality of NAR&#8217;s claims that REX uses false advertising to deceive customers.<\/p>\n","protected":false},"author":34740,"featured_media":4822,"comment_status":"open","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"_acf_changed":false,"_jetpack_memberships_contains_paid_content":false,"footnotes":""},"categories":[3255],"tags":[],"coauthors":[1760],"class_list":["post-2882","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-archive"],"acf":[],"yoast_head":"<!-- This site is optimized with the Yoast SEO Premium plugin v25.4 (Yoast SEO v26.8) -
