{"id":2215,"date":"2021-05-03T18:30:56","date_gmt":"2021-05-03T18:30:56","guid":{"rendered":"https:\/\/www.realtrends.com\/blog\/2021\/05\/03\/zillow-says-rex-antitrust-suit-wrecks-business-plan\/"},"modified":"2025-03-13T02:37:33","modified_gmt":"2025-03-13T02:37:33","slug":"zillow-says-rex-antitrust-suit-wrecks-business-plan","status":"publish","type":"post","link":"https:\/\/www.realtrends.com\/blog\/2021\/05\/03\/zillow-says-rex-antitrust-suit-wrecks-business-plan\/","title":{"rendered":"Zillow says REX antitrust suit wrecks its business plan"},"content":{"rendered":"\n<p>Zillow last week filed court documents claiming that a REX antitrust suit currently under consideration could &#8220;irreparably damage its business\u201d by causing the platform to \u201close access to listings data in markets across the country.\u201d<\/p>\n\n\n\n<p>Startup real estate company REX Homes (which isn\u2019t afraid of <a href=\"https:\/\/newsroom.rexhomes.com\/p\/rex-vs-oregon-antitrust\" target=\"_blank\" rel=\"noreferrer noopener\">litigation<\/a>) wants a federal court to stop Zillow (and company subsidiary Trulia) from separating its listings into those listed by National Association of Realtors (NAR) member agents, and those that aren\u2019t. Zillow says its contract with the NAR doesn\u2019t allow the properties to be listed together.&nbsp;<\/p>\n\n\n\n<p>Rex Homes <a href=\"https:\/\/www.realtrends.com\/blog\/rex-real-estate-files-lawsuit-against-zillow-nar\/\" target=\"_blank\" rel=\"noreferrer noopener\">in March filed suit<\/a> in Seattle federal court against Zillow Group, claiming that changes to Zillow\u2019s listing methods unfairly categorizes homes, reducing some listings\u2019 potential buyer visibility and reducing competition among agents. That filing came after Zillow gained access to the National Association of Realtors\u2019 (NAR) <a href=\"https:\/\/www.nar.realtor\/about-nar\/policies\/internet-data-exchange-idx\">Internet Data Exchange<\/a>. In order to use the NAR data, Zillow had to agree to separate its listings into \u201cagent listings,\u201d which include homes listed on an MLS, and \u201cother listings,\u201d which do not.&nbsp;<\/p>\n\n\n\n<p>Discount brokerage <a href=\"https:\/\/www.rexhomes.com\/\" target=\"_blank\" rel=\"noreferrer noopener\">REX Homes<\/a> advertises itself as \u201cthe full service, much lower-cost alternative to traditional real estate,\u201d and has been fighting with industry heavyweights for months, now, in what REX says is an attempt to \u201ccreate dramatically better outcomes and experiences for home buyers and sellers\u201d by working \u201cto reform traditional real estate by highlighting the industry\u2019s anti-competitive and predatory practices.\u201d<\/p>\n\n\n\n<p>The REX antitrust suit claims the change makes it more difficult for consumers to find homes by \u201c<a href=\"https:\/\/www.politico.com\/news\/2021\/05\/01\/zillow-antitrust-lawsuit-485178\" target=\"_blank\" rel=\"noreferrer noopener\">hiding<\/a>\u201d certain listings. In fact, in an April court filing, REX attorneys said that properties that were relocated from the non-NAR-represented hidden tab to the site\u2019s main tab got as much as a 500% increase in views.&nbsp;&nbsp;<\/p>\n\n\n\n<p>Zillow and Trulia\u2014which currently control 75% of the online real estate search market\u2014claim that if REX\u2019s injunction is granted, the company will lose access to the NAR data and thousands of listings.
